राजस्थान सरकार ने ऑनलाइन फूड डिलीवरी सिस्टम और अन्य सामान को डायरेक्ट घर तक पहुंचाने वाले गिग वर्कर्स के लिए एक बिल पास किया है.
राजस्थान की विधानसभा ने सोमवार को 'प्लेटफॉर्म आधारित गिग वर्कर्स (पंजीकरण और कल्याण) विधेयक 2023' पारित कर दिया है.
इसी के साथ राजस्थान देश का पहला ऐसा राज्य बन गया है, जहां गिग वर्कर्स को कानून के दायरे में लाने के लिए विधेयक लाया गया है और ये गिग श्रमिकों के सामाजिक सुरक्षा की गारंटी देता है.
कौन होते हैं गिग वर्कर्स?
दरअसल, हर कारोबार में कुछ काम ऐसे होते हैं जिनको स्थायी कर्मचारी के बजाए गैर स्थायी कर्मचारी से कराया जा सकता है. ऐसे काम के लिए कंपनियों कर्मचारियों को काम के आधार पर पेमेंट करती हैं. ऐसे ही कर्मचारियों को गिग वर्कर (Gig Worker) कहा जाता है. हालांकि, ऐसे कर्मचारी कंपनी के साथ लंबे समय तक भी जुड़े रहते हैं.
स्वतंत्र रूप से ठेके पर काम करने वाले कर्मचारी, ऑनलाइन प्लेटफॉर्म के लिए काम करने वाले कर्मचारी, ठेका फर्म के कर्मचारी, कॉल पर काम के लिए उपलब्ध कर्मचारी, अस्थायी कर्मचारी गिग वर्कर्स हुए.
विधेयक के अनुसार, अगर कोई इस गिग वर्कर्स एक्ट का उल्लंघन करेगा तो 5 से 50 लाख तक जुर्माना लगेगा. गिग वर्कर्स का समूहक अगर रजिस्टर्ड गिग वर्कर्स के लिए बने कानून का पालन नहीं करता है तो राज्य सरकार उस पर पहली बार 5 लाख रुपये का जुर्माना लगाएगी. यह राशि 50 लाख रुपये तक हो सकता है.
गिग वर्कर्स वेलफेयर बोर्ड का होगा गठन
राजस्थान सरकार जो विधेयक लेकर आई है, उसके तहत राज्य एक 'राजस्थान प्लेटफॉर्म बेस्ड गिग वर्कर्स वेलफेयर बोर्ड' का गठन करेगा. ये गिग श्रमिकों और एग्रीगेटर्स का रजिस्ट्रेशन सुनिश्चित करेगा. गिग श्रमिक कल्याण बोर्ड के माध्यम से ऐसे श्रमिकों को सामाजिक सुरक्षा दी जाएगी. इस बोर्ड में गिग श्रमिकों के प्रतिनिधि शामिल होंगे. इसके लिए 200 करोड़ का फंड भी स्थापित किया जाएगा. इस विधेयक का उद्देश्य एक वेलफेयर फीस डिडक्शन सिस्टम बनाना भी है. इसे एग्रीगेटर ऐप के साथ मर्ज किया जाएगा.
गिग श्रमिकों मिलेगी आईडी
यह विधेयक गिग श्रमिकों को एक विशिष्ट आईडी देगा जो सभी प्लेटफार्मों पर लागू होगा. आईडी ऐसे श्रमिकों को सामान्य और विशिष्ट सामाजिक सुरक्षा योजनाओं तक पहुंचने, शिकायत होने पर सुनवाई करने और बोर्ड में प्रतिनिधित्व के माध्यम से उनके कल्याण के लिए लिए गए सभी निर्णयों में भाग लेने में सक्षम बनाएगी.
एग्रीगेटर्स को इसके लिए एक वेलफेयर फीस भी देनी होगी, जो उनके लेनदेन का एक प्रतिशत होगा. सरकार का अनुमान है कि राजस्थान में 3-4 लाख गिग कर्मचारी हैं, जो कॉन्ट्रैक्ट और प्रति लेनदेन पर काम करते हैं. उन्हें उनके एग्रीगेटर से कोई सामाजिक सुरक्षा मुहैया नहीं कराई जाती है.

2 even as “the workers of the world” respond to new relationships of employers, employees, and workers rights in the evolving future.
3 The term “gig”
draws its etymological / व्युत्पत्ति origin from jazz musicians doing short time-based performances called “gigs” for a predetermined fee.
4 The “gig economy” is in fact
nothing more than the minute contractualisation of work, where the employer escapes from all responsibility except for determining the immediate task at hand, and arranging the payment for it.
An employer cartel calls the shots
For example, in the case of a transport-based worker such as with Uber or Ola, or many others
1 the “aggregator” uses an app-based platform to connect the “customer” with the “driver”, for which they take a healthy “commission”.
2 The app (operationalised with the help of algorithms) does the rest,
- including fixing the route,
- regulating the rides,
- paying taxes,
- and delivering profit to the company.
3 If the worker does not comply with conditions decided by the company, their “ID” is blocked, resulting in a temporary digital punishment, or digital dismissal.
4 Since the company claims not to “employ” the workers , but “partner” them, there are no employer responsibilities for wages, working conditions, or social security.
5 Needless to say, there are no “shares” of profit or company value that should accompany true partnership.
6 companies have resisted taking on the most basic responsibility for the dignity and “fair working conditions” of workers.
7 Even the few unions that have been formed are unequal to take on these employers for any kind of collective bargaining.
There is a need for the state to support gig workers
1 through law, but the neoliberal state has shown neither the appetite nor the creative responsibility to do so.
2 This is where and why the Rajasthan law is such an important breakthrough.
3 The workers, their infant unions, and the civil society and citizen groups who support them, made a demand that even the aggregators could not refuse.

They demanded social security rights through a board to be set up through a gig workers welfare law.
Even aggregators have acknowledged that the workers should have some social security.
Some companies claim that they take out accident and death insurance “at company cost”.

Gig workers today are
1 being forced to work incredibly long hours, all through the week.
2 They bear the burden for any sort of domestic or social crisis including ill health or app failure, or Internet or other shutdowns
3 while companies take advantage of rising unemployment or faltering economies to offer unemployed workers partnerships (work) with no strings attached.
The hamal model
“Hamal Panchayat” in Maharashtra
More than 60 years ago, people who carried sacks on their head or shoulders (called hamals) formed a union called the “Hamal Panchayat” in Maharashtra.
They faced the same set of problems that most unorganised sector workers face, but in a more acute form.
They had no single workplace, or “employer”. The employers were merchants and the workers from poor and mostly Dalit or Other Backward Class families from the rural hinterland.
After earning for a short period, when their bodies could no longer take the backbreaking work, they would go back home to fade away.
- They had nothing to fall back on during illness, accident, or old age.
- They had no minimum wages,
- no pension,
- no sick leave,
- no health or education benefits and no employer to collectively bargain with.
They came up with a brilliant formulation
1 that they fought hard to implement, and emerged with a law that has served as the conceptual foundation for unorganised sector workers rights in the country.
2 “Mathadi board”
Led by Baba Adhav, now 94, they demanded and won a law that set up a “Mathadi board” which would register both workers and merchants who used the labour of hamals.
3 Every shopkeeper was registered and required by law to deposit the workers’ wage and a “levy on every sack carried” with the board, which was to be paid to the worker once a month.
The levy, acknowledged to be a part of their “piece rate wage”, was to be used for social security schemes and programmes launched and managed by the board.
These included gratuity, health and education benefits, and other rights that were considered impossible to secure.
So effective was this law that the Hamal panchayat has its own bank, housing scheme (flats for hamals), and school.
It has even set up unions for others which include autorickshaw drivers and waste pickers.
The board brought them together, the law gave them collective legitimacy, and the capacity to secure their social security money, and true “partnership”
in the union allowed them to create some of the most innovative social security benefits from their own legitimate wages.
what is the result
