new Post Office Bill (2023)
introduced in the Rajya Sabha , is to replace the Indian Post Office Act (1898)
in the light of the changing role of post offices where its “network has become a vehicle for delivery of a variety of citizen centric services”.
Old vs New
1 While the 1898 Act had focused only on mail services.
2 the new Bill authorises the Director General
of Postal Services to make regulations related to activities necessary for providing various such other services as the central government may prescribe, and to fix charges of them.
3 This provision is important as parliamentary approval will not be a prerequisite शर्त for revision of charges for any service offered by post offices, including traditional mail services.
What changes
1 new Bill gives the postal department, flexibility in deciding the prices of its services in a fiercely competitive industry and help in responding quickly to market demands.
2 Also, various initiatives of India Post to dispense citizen-centric services will now be based on a strong legal framework.
3 The new Bill authorises the central government which “may, by notification, empower any officer to cause / stop any item in transmission by the Post Office to be intercepted, opened or detained
Reason -
in the interest of the security of the State, friendly relations with foreign states, public order, emergency, or public safety or upon the occurrence of any contravention of any of the provisions of this Act....”.
4 Even in the existing Act (1898), there was provision for the Postal Department
to open and destroy any postal article containing “explosive dangerous, filthy, noxious or deleterious substance” (Section 19, 19A, 23(3)(a) refer).
5 new Bill will arrest possibilities of smuggling and unlawful transmission of drugs and other contraband goods through postal parcels.
But There is no similar legislation for courier firms
1 India Post has a share of less than 15% of the market in the courier/ express/parcels (CEP) industry,
2 and so the effectiveness of the provision to intercept, open or detain any item in the course of postal transmission on the grounds of national security and public service has its limitations.
3 A major part of the domestic courier industry is made up of medium and small players.
4 If the Bill had any provision for such operators to register with any designated authority
and if the central government had retained the authority to intercept and open parcels in the course of transmission by the couriers,
that would have given teeth to the Bill to control the movement of contraband goods in parcels.
Futuristic postal delivery
The new Bill provides the central government - standards
1 for addressing on the items, address identifiers and usage of post codes”.
2 but This provision will have a far-reaching impact as the physical address may be replaced by a digital code using geo-spatial coordinates to identify a specific premise.
डिजिटल एड्रेस कोड क्या है (What is Digital Address Code)इसका मतलब यह है कि भारत के हर मकान का एक अपना यूनिक कोड होगा। जैसे हर घर का अपना एड्रेस होता है वैसे ही आने वाले समय में एड्रेस से ज्यादा मकान को उसके यूनिकोड से पहचाना जाएगा यानी उसके डिजिटल एड्रेस कोड से।
3 Digital addressing, though a futuristic concept, may ease the process of sorting and facilitate accurate delivery of mails and parcels.
4 This provision may even facilitate the delivery of parcels by drone, as is being experimented in some countries. However, there is a long way to go.
विधेयक का सबसे महत्वपूर्ण पहलू 1898 अधिनियम के खंड 4 में अब तक/अब तक मौजूद प्रावधान को हटाना है:
"केंद्र सरकार को सभी पत्रों को एक स्थान से दूसरे स्थान तक डाक द्वारा पहुंचाने का विशेष विशेषाधिकार होगा...

1980 के दशक से भारत में कोरियर को संचालित करने की अनुमति मिलने के बाद से इस प्रावधान ने अपनी प्रासंगिकता खो दी है।
ऐसा इसलिए हुआ क्योंकि अधिनियम या उसके बाद के भारतीय डाकघर नियम, 1933 में कहीं भी 'पत्र' की परिभाषा का उल्लेख नहीं किया गया था।
'पत्र' और 'दस्तावेज़' की अवधारणाओं को ओवरलैप करने वाला एक बड़ा अस्पष्ट क्षेत्र है।
कानून की नज़र में, अब तक कोरियर जो वितरित करते थे वह 'दस्तावेज़' और 'पार्सल' थे, न कि 'पत्र'।
एक बार जब नया विधेयक अधिनियम बन जाता है, तो ये सभी कानूनी बहसें कि क्या पत्र बनता है और क्या नहीं, स्वतः ही समाप्त हो जाएगा।
कानूनी प्रावधान जो भी हो, एक आम आदमी पत्र को दो व्यक्तियों के बीच संचार का एक लिखित और व्यक्तिगत रूप मानता है, जो डाक द्वारा भौतिक रूप से भेजा जाता है।
मोबाइल क्रांति के बाद इस तरह के लिखित व्यक्तिगत संचार का महत्व काफी हद तक कम हो गया है।
ऐसे में, नए डाकघर विधेयक में केंद्र सरकार द्वारा "विशेष विशेषाधिकार" के प्रावधान को खत्म करना सही दिशा में एक कदम है और वास्तविकता की स्वीकृति है।
